Updated 03:16 8 Oct 2026 GMT+1Published 02:25 8 Oct 2026 GMT+1Texas executes Jamaal Howard America’s first death row inmate since the failed Christa Pike lethal injection attemptThe 46-year-old spent more than two decades on death row Death row inmate Jamaal Howard has been executed in Texas.Howard has become the 30th person to be executed in the US this year and the first since Christa Pike’s failed attempt in Tennessee.Howard, 46, was pronounced dead at 8.03pm local time after receiving a fatal dose of pentobarbital at the state prison in Huntsville.He was sentenced to the death penalty for the 2000 murder of Vickie Swartout during an attempted robbery.AdvertHoward was said to be ‘chatty’ during the 45-minute journey from death row to the Huntsville Unit where executions are carried out.Amanda Hernandez, a spokesperson for the Texas Department of Criminal Justice, said: “He made small talk with the officers through the whole trip.”Once inside, he was taken to a holding cell inside the death chamber.Jamaal Howard was executed on 7 October (State of Texas 356th Judicial Court)“He was asking questions and was very engaged in the process,” Hernandez said.Earlier today, his legal team had unsuccessfully tried to block the execution, claiming that Howard was intellectually disabled and raising concerns about the use of pentobarbital - the same drug that had been used in Pike’s execution attempt on 30 September.A One filing from his team read: “Ms. Pike survived two lethal doses of pentobarbital, the same drug used in executions in Texas, and she reportedly remains hospitalised in critical condition.“When an execution goes wrong, one of the first questions anyone asks is whether the drug was what the State said it was.“Tennessee’s own officials cannot yet answer that, and the answer lies in records: when the drug was bought, from whom, how it was stored, and what testing was done and when. Texas should not wait until after a failed execution to ask the same questions.“We do not know why Ms. Pike’s execution failed, and we, specifically, do not know whether the failure was due to the pentobarbital’s being ineffective.”According to his spiritual advisor Reverend Jeff Hood, at trial, psychiatrists determined that Howard's IQ is in the the 65-70 range, while they described him as functioning at the level of an 11 or 12-year-old.Writing in the Texas Observer ahead of the execution, Hood claimed that Howard ‘didn’t understand how executions were carried out’ and that he had not heard of the Pike case or the media storm surrounding it.He said that when he told Howard that at Pike’s execution the drugs didn’t work, he matter-of-factly replied: “I guess if the drugs don’t work, they’ll just shoot me in the head.”He said that he told Howard that executions didn’t work like that but claimed he ‘literally had no understanding of the protocol by which he was going to be executed or what would happen if something went wrong’.Pike's legal team have confirmed that she is now 'conscious and speaking' following her botched execution attempt last month.In a new update earlier today, her team said that she could remember her name but when asked the date she still believed it was September.Dr Joel Zivot, the anaesthesiologist advising her team, shared more details on her condition."She has some memories of being in the hospital but no memory, I believe, of the execution attempt," he told the BBC.Tennessee has paused all upcoming executionsIn the wake of her execution attempt, Tennessee has announced that all further planned executions be halted until an investigation into the matter is carried out.A statement issued by the Tennessee Department of Correction said that they 'followed every step of the State’s lawful, established execution protocol approved by the Attorney General’s Office.'(LADbible)"The Tennessee Department of Correction followed every step of the state’s lawful, established execution protocol approved by the Attorney General’s Office," the statement said."The lethal injection chemical in the protocol has consistently been effective, and the protocol does not allow for additional procedures beyond what was carried out this evening. The report has not been independently verified; however, the WHO has commented on the second case.On Wednesday Tedros Adhanom Ghebreyesus, the WHO director general, said: “We don’t yet have the full picture of this event and we’re not able to conduct a full risk assessment.“Timely, complete and transparent information sharing is essential to clarify conflicting reports and enable an accurate assessment of potential public risks.”Tedros also asked for an explanation from Russia following reports of ‘a second employee with pneumonia of undetermined cause’.“We assess any reporting from the community,” he said. “We asked Russia to respond to that. Supreme Court Justice Neil Gorsuch paused oral arguments on Wednesday to correct a comment Sopan Joshi, assistant to the solicitor general, made regarding something the Court said. The case, Department of the Air Force v. Prutehi Guahan, an environmental group, focuses on the central question of whether the Air Force should have to get an environmental study done before applying for a permit to burn old explosives and munitions. The Air Force argued they shouldn’t need to do the study in order to apply for the permit, while Prutehi Guahan argued that there are risks to Guam’s water supply and endangered species and agencies need to have all the information about environmental impacts when they make the decision about the permit. Early in the oral arguments, Joshi argued that two statutes enacted by Congress are inconsistent. He said the Resource Conservation and Recovery Act (RCRA) requires environmental analysis at various stages of the permit process, thereby displacing the National Environmental Policy Act (NEPA). Gorsuch said the Supreme Court usually asks people to comply with both of Congress’ commands if they can. Joshi responded that he didn’t think the norm was “that absolute” and started to make an argument about what should happen when a “more specific statute is inconsistent with a general one.” Gorsuch cut him off and said, “I didn’t say ‘inconsistent,’ Counsel. I said if you can do both, there’s no conflict and we try to reconcile and obey all of Congress’ commands.” ...How the US Gets Rid of Old MunitionsFor decades, the Air Force has used Tarague Beach to get rid of old munitions and explosives, and in 2021, the agency applied for a permit to continue doing so. When the Air Force applied for the permit, it followed protocol under RCRA, but Prutehi Guahan argued that the agency also has to comply with NEPA. Under NEPA, federal agencies have to conduct environmental impact studies and allow for public comment before making major decisions. Prutehi Guahan argued the munitions disposal runs the risk of harming the ecosystem and threatens water resources.Government attorneys, though, have argued that following RCRA means they don’t have to follow NEPA and therefore didn’t have to get the environmental study before applying for the permit. Attorneys also argued that since the Environmental Protection Agency in Guam hasn’t made a decision on the permit, the lawsuit was filed too early. Treating applications would open the door to lawsuits at every stage of the permitting process, according to government attorneys. NEPA & RCRA CollaborationLike Gorsuch, Justice Sonia Sotomayor questioned why NEPA and RCRA couldn't operate in conjunction with one another, and Justice Brett Kavanaugh questioned the practicality of environmental reviews coming only after a decision on the permit was made. "That's just completely counterintuitive," Kavanaugh said. "[It] extends everything and contrary to everything, about trying to get these things done expeditiously." Justice Clarence Thomas also questioned Prutehi Guahan about precedent treating a permitting application as a final agency action, highlighting a potential weakness in the case. Ultimately, the court appeared divided on concerns about opening the door to premature litigation and the possibility of creating a loophole that shields environmental decisions from judicial review.
