Former Judge Hannah Dugan Avoids Prison After Controversial ICE Incident New

Former Judge Hannah Dugan Avoids Prison After Controversial ICE Incident

For more than a year, a brief confrontation inside a Wisconsin courthouse has fueled one of the country’s most closely watched legal battles, drawing fierce reactions from supporters and critics alike. The case quickly evolved beyond the actions of a single public official, becoming a flashpoint in the national debate over immigration enforcement, judicial authority, and whether elected judges can be held criminally responsible for decisions made from the bench.Former Wisconsin Judge Hannah Dugan learned her fate Wednesday after being sentenced to pay a $5,000 fine for obstructing the arrest of an illegal immigrant, avoiding prison even though federal prosecutors sought a sentence of between 15 and 21 months.U.S. District Judge Lynn Adelman declined to impose any jail time after Dugan’s felony conviction, saying he believed she was “an otherwise good person” who made a poor decision while upset over the nation’s immigration policies.“I think this is a situation where an otherwise good person, upset by immigration policies in this country, made a bad decision in the moment,” Adelman said.Dugan, 66, was convicted last year of felony obstruction after federal immigration agents attempted to arrest Eduardo Flores-Ruiz at the Milwaukee County courthouse on April 18, 2025.She was acquitted on a separate misdemeanor charge alleging she concealed an individual to prevent an arrest. The conviction carried a potential sentence of up to five years in prison.Just before her sentencing, Dugan defended her conduct and said she hopes to continue serving the public despite resigning from the bench earlier this year.“My acts that day were consistent with community concerns at the courthouse,” Dugan told the court.“My judicial acts were not done with any malicious intent or to advance any personal interests.”Dugan said the prosecution forced her retirement and ultimately led to her resignation in January so another judge could take over her courtroom.“I have been cast as a scofflaw and as a hero. I am neither. I am a public servant who was just trying to do my job,” she said.“Your honor, I will not let those minutes on April 18, 2025, define my life’s work.”Republican lawmakers had previously threatened to impeach Dugan, describing her as an activist judge following the incident.Several supporters testified on her behalf before sentencing, arguing she had already suffered significant personal and professional consequences.“Hannah models what it means to be Christian,” said the Rev. Gregory J. O’Meara, a Jesuit priest, attorney and law professor.“We’ve made arrangements to hold services for her privately because she’s been hassled.”“I do not think there is a need for further punishment, deterrence, retribution or reform.”Marquette University law professor Janine Geske also urged the court to show leniency.“She has lost her profession and her income, and she’s here humbly to ask you to give her the opportunity to return to the community,” Geske said.According to prosecutors, ICE agents arrived at the Milwaukee County courthouse after learning Flores-Ruiz, 31, who authorities said had illegally reentered the United States, was scheduled to appear before Dugan in a state domestic violence case.Federal prosecutors alleged Dugan confronted the agents, argued their administrative warrant was insufficient, directed them toward the chief judge’s office and then instructed Flores-Ruiz and his attorney to leave through a back door.Agents later spotted Flores-Ruiz outside the courthouse and arrested him after a brief foot chase.Dugan’s attorneys argued throughout the case that her judicial position should have protected her from prosecution, but the court rejected that argument.“What judges around the country are looking at this case and saying, ‘Yes, sign me up?’ There won’t be a crime wave of judges defying ICE,” defense attorney Steve Biskupic argued before sentencing, Fox News reported.Flores-Ruiz has since been deported, while Dugan says she intends to return to public service following the conclusion of the case. This article may contain commentary which reflects the author's opinion.

New

Why Brig. Gen. Eric Widmar's Departure is Stirring Pentagon Conversations New

Why Brig. Gen. Eric Widmar's Departure is Stirring Pentagon Conversations

The senior legal adviser to Joint Chiefs of Staff Chairman Gen. Dan Caine is stepping down nearly a year before his expected retirement, becoming the latest senior Pentagon official to depart since the start of President Donald Trump’s second administration.Brig. Gen. Eric Widmar told ProPublica that he was leaving the position for “personal reasons” after serving as the chairman’s senior legal counsel since 2024.“Earlier this year, my wife and I reflected on the demands of this role, which have required me to live apart from my wife for the past two years and created additional challenges for me and my family,” he said in a statement to the outlet.“After careful consideration, I decided it was time to place my family at the center of my life and focus on our next chapter together,” he added, per the left-wing outlet.Widmar’s departure follows a series of high-profile leadership changes at the Pentagon over the past 18 months.Among them was Gen. Christopher Donahue, the former commander of U.S. Army Europe and Africa, who reportedly left his post last week after being removed before completing his expected term by War Secretary Pete Hegseth.Earlier this year, Hegseth also replaced Army Chief of Staff Gen. Randy George, ending his tenure roughly halfway through what is typically a four-year assignment. The leadership changes continued late last year when Hegseth removed Adm. Alvin Holsey as commander of U.S. Southern Command, despite roughly two years remaining in his expected term.Holsey had been overseeing operations that included drone strikes targeting suspected drug-smuggling vessels in waters near South America.Shortly after taking office in February 2025, Hegseth also dismissed the top uniformed legal advisers for the Army, Air Force and Navy.At the time, he said he did not believe they were “well-suited” to provide legal guidance on military orders. The dismissals drew concern from some legal scholars and former military officials, who argued the changes could weaken the military’s traditional system of legal oversight and adherence to the laws of armed conflict as the Pentagon emphasized a more combat-focused “warrior ethos,” The Hill reported. All said, however, Trump, as commander-in-chief, and Hegseth, as head of the War Dept., are entitled to service commanders who share their vision for the military. If those officers do not share a similar vision or have their own ideas about how things should be run, they shouldn’t remain in their positions, experts have noted. But there is no indication that Widmar held a different vision for the military or that he was in disagreement with any of Trump’s policies and vision.Caine, the principal military adviser to Trump and Hegseth, said in a statement to The Hill that Widmar “is a fantastic Officer and Lawyer” who served the entire U.S. and thanked him for his “remarkable” service.“I’m personally deeply grateful for Eric and his Family’s service and deeply respect his decision to prioritize his family as he moves on to the next chapter,” Caine said.“He is deeply respected and admired by all. … We will miss his legal counsel, incredible expertise and experience, and his understanding of our responsibility to always speak truth to power,” Caine added.A graduate of the U.S. Military Academy at West Point, Widmar has served in the Army for more than 28 years. Before becoming senior legal counsel to the chairman of the Joint Chiefs of Staff, he served as staff judge advocate for U.S. Central Command, where he oversaw a team of more than 150 legal professionals representing all five branches of the U.S. military, said The Hill.According to a December CNN report, Widmar advised Caine in November that military commanders who believe they have received an unlawful order should request retirement rather than resign in protest or openly challenge the directive. The reported guidance came amid ongoing debate among lawmakers and legal experts over the legality of U.S. military operations targeting suspected drug-smuggling vessels in the Caribbean Sea and eastern Pacific Ocean. This article may contain commentary which reflects the author's opinion.
